These Terms & Conditions (“Terms”) govern the access to and use of the messaging, communication, and related digital services (“Services”) provided by SACHIN POTE, having its principal place of business at Tiwari Chawl, Tisgaon Road, Near Datta Mandir, Mhasoba Chowk, Kolsewadi, Kalyan East, Thane, Maharashtra – 421306, India.
By accessing, registering, or using our Services, you agree to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.
1. Introduction
SACHIN POTE operates as a service provider facilitating business messaging, customer communication, and notification services through WhatsApp Official Business API and RCS (Rich Communication Services) platforms. These Terms define the legal relationship between SACHIN POTE and its users, clients, or partners (“Users”).
2. Definitions
- “Company”, “We”, “Us”, or “Our” refers to SACHIN POTE
- “User” refers to any individual or entity using our Services
- “Services” means messaging, notification, automation, and communication services
- “Platform” refers to WhatsApp, RCS, or any associated technology
- “Meta” refers to Meta Platforms Inc.
- “Content” includes text, media, data, and templates sent through Services
3. Acceptance of Terms
By creating an account, submitting data, or using our Services, you acknowledge that you have read, understood, and agreed to these Terms, along with all applicable laws and Meta/RCS policies.
4. Description of Services
SACHIN POTE provides:
- WhatsApp Business API onboarding & messaging services
- RCS-based customer communication
- Transactional, promotional, and service-related notifications
- Messaging templates, delivery reports, and basic analytics
We act as an intermediary and do not control WhatsApp or telecom infrastructure.
5. Eligibility
You must:
- Be at least 18 years old
- Have legal authority to represent your business
- Comply with Indian laws and platform policies
Use by prohibited industries or illegal activities is strictly forbidden.
6. Account Registration
Users must provide accurate business information.
You are responsible for maintaining confidentiality of credentials and all activity under your account.
7. User Responsibilities
Users agree to:
- Obtain explicit user consent before messaging
- Send only compliant, lawful messages
- Not misuse, spam, deceive, or violate policies
- Maintain accurate opt-in records
Any violation may result in suspension without notice.
8. Payment & Billing Terms
- Fees are communicated prior to service activation
- Payments are non-refundable unless stated otherwise
- Taxes applicable under Indian law shall be borne by the User
9. Subscription Renewal & Termination
Subscriptions may auto-renew unless cancelled.
We reserve the right to suspend or terminate access for violations or non-payment.
10. Use of WhatsApp Official API & RCS
Users must comply with:
- Meta WhatsApp Business Policies
- RCS GSMA guidelines
- Telecom regulations
Approval and access are subject to platform discretion.
11. Message Delivery & Compliance Policy
Delivery is dependent on third-party platforms and networks.
SACHIN POTE does not guarantee delivery or response rates.
12. Intellectual Property Rights
All software, documentation, branding, and systems belong to SACHIN POTE or its licensors.
Users receive a limited, non-transferable usage license only.
13. Confidentiality
Both parties agree to protect confidential information and use it solely for service purposes.
14. Disclaimer of Warranties
Services are provided “as is” and “as available.”
We disclaim all warranties, express or implied, to the fullest extent permitted by law.
15. Limitation of Liability
To the maximum extent allowed under Indian law, SACHIN POTE shall not be liable for indirect, incidental, or consequential damages.
16. Indemnification
Users agree to indemnify and hold harmless SACHIN POTE from claims arising from misuse, violations, or unlawful content.
17. Governing Law (India)
These Terms are governed by the laws of India.
Courts of Maharashtra shall have exclusive jurisdiction.
18. Changes to Terms
We may update these Terms periodically. Continued use constitutes acceptance of changes.
